regulations covering "safety sensitive" personnel

personnel designated "safety sensitive" by
Federal Department of Transportation (DOT) rules
and regulations to include but not limited to;
CDL operators, supervisors, mechanics, dispatchers,
and yard traffic management operators, regardless

The Federal rules
prohibit making disclosure of this information unless
further disclosure is expressly permitted by the written
consent of the person to whom it pertains or as otherwise
permitted by 42CFR Part 2.
A general authorization
for the release of medical or other information is
not sufficient for this purpose.
The Federal rules
restrict any use of the information to criminally investigate
or prosecute any alcohol or drug abuse client.

V.
Comprehensive Coverage:
The Substance Abuse
Professional (SAP) will be responsible for performing
the following services:
- Conduct
mandatory "face
to face" personal assessments
- Develop education
and treatment requirements
- Refer to professional
community service providers
- Monitor referrals
for successful compliance or non-compliance
- Conduct final
treatment evaluations and return to duty testing
- Develop follow-up
testing schedule and implementation plan
- Maintain confidential
record storage
